cookie law popup

Hi, i've been a bit out of touch this past while so forgive me if this isn't relevant :

I was at a google 'digital garage' presentation on Monday and was told that google now penalises websites with popups.

isn't the eu cookie law warning implemented as a popup ?

If so, it will need reviewed asap

In any case, it would be great if the cookie warning slid on as a banner from the top or bottom of the screen as it does in more modern site designs

I would say it's not a modal window. So I think it's fine
