This is not available out of the box. You can enable it when checking out (in every purchase) or when registring (https://www.nopcommerce.com/boards/t/15389/question-about-adding-checkbox-in-register-page.aspx)

passed the problem via cookie controlled javascript in Views\Shared\_Root.cshtml that calls http://localhost:50905/t-popup/conditionsofUse
